What is Real Estate Professional Status (REPS)?

Real Estate Professional Status is an IRS tax classification under IRC §469(c)(7). Qualifying lets you treat rental real estate losses as non-passive, so they can offset W-2 wages, business income, and other active income instead of being suspended as passive losses. To qualify you must materially participate in your rental activities and meet two time-based tests for the tax year.

What are the IRS tests to qualify for REPS?

There are two qualification tests, both evaluated for each person individually: (1) you must spend more than 750 hours during the tax year in real property trades or businesses in which you materially participate, and (2) more than half of all the personal-services time you spend in any trade or business must be in real property trades or businesses. You also have to materially participate in each rental activity — most commonly proven with the 500-hour material-participation test.

What hours count toward the 750-hour test?

Time you personally spend operating, managing, and developing your rental real estate — for example tenant management and showings, maintenance and repairs, property research and acquisition analysis, financing and closing work, bookkeeping, travel to and from properties, and continuing education. Investor-type activities and time as an employee generally do not count unless you own at least 5% of the employer. The simulator splits this into hands-on "material" hours and other "non-material" qualifying hours, then adds them together.

How does the more-than-half (50%) test work?

More than 50% of the personal services you perform in all trades or businesses during the year must be in real property trades or businesses in which you materially participate. If you also work a non-real-estate job, those hours go into the denominator. Enter your non-RE work in the simulator and it annualizes it to check whether your real-estate hours stay above half of your total working time.

Does my spouse’s time count toward REPS?

The 750-hour and more-than-half tests must be satisfied by one spouse individually — you cannot combine hours to clear them. However, once a spouse qualifies, both spouses’ hours count toward the material-participation (500-hour) test for the rentals. Switch the simulator to "MFJ" to model each spouse separately for the 750-hour and 50% tests while combining material-participation hours.

What is the 500-hour material participation test?

Material participation means you are involved in the operation of an activity on a regular, continuous, and substantial basis. The most common way to prove it is the 500-hour test — 500 or more hours in the activity during the year. For multiple long-term rentals you can elect to group them as a single activity so the hours combine. The simulator tracks your combined material-participation hours against the 500-hour goal.

How does the year-end projection work?

Enter the hours you have already logged this year plus the pace you expect to keep going forward (hours per property per week). The simulator projects your hours to December 31 using the weeks remaining in the tax year, then compares your projected totals against the 750-hour, 50%, and 500-hour thresholds so you can see whether you are on track — and adjust your pace before year-end.
