What Is IRS Real Estate Professional Status?

IRS Real Estate Professional Status (REPS) is one of the most powerful tax benefits available to real estate investors. It allows you to reclassify rental income from “passive” to “non-passive,” enabling you to deduct rental losses — including depreciation — against your ordinary W-2 or business income. To qualify, the IRS requires you to meet these tests every tax year.

The 750-Hour Test

You must spend at least 750 hours per year working in real estate trades or businesses. Qualifying activities include property management, maintenance and repairs, tenant communications, lease negotiations, and administrative work like bookkeeping. The IRS requires a contemporaneous activity log — you need to document your hours as you go, not reconstruct them at year-end.

How the 750-hour and 50% tests work

The 50% Rule

More than half of all your working hours for the year must be spent in real estate activities. If you work 2,000 hours at a W-2 job and 750 hours in real estate, you fail — because 750 is only 27% of your 2,750 total hours. This is why many investors who claim REP status reduce non-real-estate work hours or time their qualification carefully.

Material Participation

Beyond meeting the 750-hour and 50% requirements, you must also materially participate in each rental property or group of properties. What Is Short-Term Rental Material Participation?

Short-term rental properties with an average guest stay of fewer than 7 nights are treated differently by the IRS. Under the 7-day rule, these properties may be classified as non-rental businesses — which means STR owners can potentially deduct losses without REP status, but must prove material participation through one of the IRS tests below.

Only short-term rental properties with an average guest stay of fewer than 7 nights qualify for non-rental business treatment under IRS rules. This classification is what allows STR owners to deduct losses without REP status — but it must be proven with data. You must spend at least 100 hours on your STR activities during the year, and your participation must be more than any other individual — including property managers, cleaners, and contractors. The Substantially All Test

The STR owner must show that they performed substantially all of the work for their properties — typically more than 90% of total hours.
